Alice Cooper “Keepin' Halloween Alive” Cooper-oke Contest

Many will enter and compete in the Contest, but few will be selected. Winners will be selected and prizes awarded in the sole discretion of the Contest judges.

No purchase or payment is necessary to enter and win. A purchase will not improve an entrant’s chances of winning. Void where prohibited or restricted by law.

Eligibility
“Keepin' Halloween Alive” Cooper-oke Contest is open only to those entrants who are 18 years of age and over as of October 1st, 2009.

How to Enter:

1) Read the official rules.

2) Go to iTunes to purchase the "Keepin' Halloween Alive" Digital 45, including the bonus Cooper-oke mix. No purchase is necessary: you can also download the Cooperoke mix for free at nightswithalicecooper.com.

3) Bone up on the lyrics, available in the digital booklet or at no charge through nightswithalicecooper.com.

4) Practice by viewing a video of the song with lyrics -- viewable at nightswithalicecooper.com.

5) Upload a video of yourself singing along to the Cooper-oke mix of “Keeping Halloween Alive,” using iTunes or another service, and fill out the entry form at nightswithalicecooper.com.

6) Listen to Nights With Alice Cooper, where winners will be announced sometime in November, or check on nightswithalicecooper.com.

General Conditions
By entering the “Keeping Halloween Alive” Cooper-oke Contest, each entrant accepts and agrees to be bound by these rules and by the decision of the judges, which shall be final and binding in all respects. Taxes, if any, are the sole responsibility of the prize winners. No substitution or transfer of prizes permitted. Nightswithalicecooper.com reserves the right to substitute a prize for one of equal or greater value in the event that an advertised prize is unavailable.

All prize winners may be required to submit valid identification and to execute an affidavit of eligibility and a liability/publicity release within thirty (30) days following first attempted notification. Failure to comply within this time period may result in disqualification and awarding of the prize to the entrant with the next highest score. By entering, participants agree to release, indemnify and hold harmless Nights with Alice Cooper, United Stations Radio Networks, Alive Entertainment, Shout! Factory, LLC and their respective subsidiaries, sponsors, affiliates, directors, officers, employees and agents (“Released Parties”) from any and all liability or any injuries and/or death, loss or damage of any kind arising from or in connection with participation in this contest or the acceptance, possession or use of any prize won in connection with this game. In no event will the Released Parties be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of an entrant’s participation in the Contest and/or access to or use of the Nightswithalicecooper.com website or downloading from and/or printing material downloaded from said website.

Contestants agree to nightswithalicecooper.com’s use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited or restricted by law.

All federal, state and local laws and regulations apply.

Nightswithalicecooper.com is not responsible for lost, late or misdirected on-line entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment or technical malfunction or for any human error, technical error or malfunctions.

Nightswithalicecooper.com is not responsible for typographical or other human or technical errors in the offer or administration of the “Keeping Halloween Alive” Cooper-oke Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes.

Nightswithalicecooper.com, in its sole discretion, may disqualify any entrant from participating in the contest and require the return of any prizes, if entrant engages in any conduct nightswithalicecooper.com deems to be improper, unfair or otherwise adverse to the operation of the contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during contest registration or prize claim or violating any term or condition stated herein.

Nightswithalicecooper.com reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the contest.

This contest may not be used for any form of gambling.

Prizes
The first place winner of the “Keeping Halloween Alive” Cooper-oke contest will be awarded US$1,000. Second place, US$500, and third place, US$250. Taxes, if any, are the sole responsibility of the prize-winners. No substitution or transfer of prizes is permitted. Decision of the judges is final. Payment of prize monies shall be made 8-10 weeks following final verification of a prize winner’s eligibility.

If, for any reason, the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of nightswithalicecooper.com which corrupt or affect the administration, security, fairness, integrity or proper conduct of this contest, nightswithalicecooper.com reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest.

Nightswithalicecooper.com assumes no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or transactions. Nightswithalicecooper.com is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this contest.

CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, NIGHTSWITHALICECOOPER.COM, INC. RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Any entry that is incomplete, late or does not include a validly issued User ID will be disqualified.

In the event that the “Keeping Halloween Alive” Cooper-oke Contest is challenged by any legal or regulatory authority, nightswithalicecooper.com reserves the right to discontinue or modify the Contest or disqualify participants residing in the affected geographic areas. In such event, nightswithalicecooper.com shall have no liability to any players who are disqualified due to such an action.

The “Keeping Halloween Alive” Cooper-oke Contest runs from October 1, 2009 at 12:00:01 A.M. Eastern Time (“ET”) and ends October 31st, 2009 at 11;59:59 P.M. ET. The Contest Administrator’s computer shall be the official time keeping device for the Contest. Winners will be chosen by Alice Cooper and/or judges appointed at the discretion of Nights With Alice Cooper and Alive Entertainment on or about November 1, 2009.. Winners will be announced on Nights with Alice Cooper and on nightswithalicecooper.com and alicecooper.com on or about November 6, 2009. Void where prohibited or restricted by law. Entrants must be 18 years of age or older to enter. No purchase or payment is necessary. Decision of the judges is final.

Except where prohibited, entrant agrees that (1) any and all disputes, claims and causes of action arising out of or connected with the Contest shall be resolved individually and without resort to any form of class action, and exclusively in the United States District Court, which may have jurisdiction over any such dispute, claim or cause of action; and (2) any and all claims, judgments and awards shall be limited to actual, out-of-pocket costs incurred, including costs associated with entering the Contest, if any, but in no event shall such costs include attorneys’ fees incurred by the entrant. All issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, or the rights and obligations of the entrant, Contest Sponsor(s) and/or Contest Administrator(s) shall be governed by and construed in accordance with the laws of the State of New York without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
